The Right to Protest

The First Amendment of the U.S. Constitution protects the right to protest, but there are some restrictions:

  • PermitsSome events require a permit, such as parades, large rallies, or protests that block traffic. However, the government can't deny a permit just because it doesn't like the message of the protest.

  • PermitsSome events require a permit, such as parades, large rallies, or protests that block traffic. However, the government can't deny a permit just because it doesn't like the message of the protest.  
  • Time, place, and mannerThe government can impose reasonable restrictions on when, where, or how a protest can take place. For example, the government can prohibit loud demonstrations late at night.  
  • Obstructing trafficProtests that block traffic are usually illegal without a permit. Protesters without a permit should stay on sidewalks and not obstruct pedestrian or other traffic.  
  • Private propertyProtesting on someone else's private property without permission is not protected by the law.  
  • HarassmentProtesters cannot physically harass people.  
  • Interfering with policeProtesters can videotape the police, but they should not interfere with them.  

Here are some other things to keep in mind when protesting:

  • Carry ID  
  • Make arrangements with friends in case you are arrested  
  • Memorize important phone numbers  
  • Avoid carrying drugs or weapons  
  • Consider the immigration consequences of protesting  
  • Consider how your actions could be interpreted in your home countr
